1.Application of these Terms
- 1.1These Terms apply to every Order and to the supply of all Goods by us, and form part of each Contract.
- 1.2Where a Quote is inconsistent with these Terms, the Quote prevails, but only in respect of the Goods to which that Quote relates and only to the extent of the inconsistency.
- 1.3Information technology, website and software services are supplied on our separate Terms of service and are not governed by these Terms.
- 1.4Terms proposed or supplied by the Customer do not form part of a Contract unless we agree to them in writing.
- 1.5Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the ACL or any other law that cannot lawfully be excluded, restricted or modified.
2.Orders and formation of the Contract
- 2.1An Order is an offer by the Customer to purchase the Goods described in it at the prices displayed at the time the Order is placed.
- 2.2The Customer must ensure that all information provided with an Order, including the Delivery Address and contact details, is complete and accurate.
- 2.3A Contract is formed when we have received payment for the Order and issued an Order Confirmation.
- 2.4We may decline any Order before a Contract is formed, including where a price or description has been displayed in error, where we are unable to supply the Goods, or in the circumstances described in clause 9.7. If we decline an Order, we will refund in full any amount paid.
- 2.5The Customer may view each Order, its status, receipts and correspondence, and communicate with us about it, through their account, accessed using the email address with which the Order was placed.
3.Prices and payment
- 3.1All prices are in Australian dollars.
- 3.2We are not registered for GST at the date of the Order, and no GST is charged.
- 3.3Postage is calculated at checkout from the rates of Australia Post for the Delivery Address and the delivery service selected, and is shown before payment is made.
- 3.4Payment by card, Apple Pay, Google Pay or Link is processed by Stripe Payments Australia Pty Ltd. Card details are provided directly to Stripe and are not received or stored by us.

4.Promotion Codes
- 4.1A Promotion Code may be used only in accordance with the conditions displayed when it is issued or applied, including any expiry date, minimum order value, limit on the number of uses, or restriction to a first order.
- 4.2Unless we state otherwise, only one Promotion Code may be applied to an Order. A Promotion Code has no cash value, cannot be exchanged, and does not apply to an Order placed before it is applied.
- 4.3We may withdraw or vary a Promotion Code at any time, without affecting any Contract already formed.
5.Production and delivery
- 5.1All Goods are made to order. We will dispatch the Goods within the Production Period, unless prevented by circumstances beyond our reasonable control, in which case we will notify the Customer and dispatch the Goods as soon as reasonably practicable.
- 5.2We deliver only to addresses in Australia, by the Australia Post service selected at checkout. We do not offer collection of Goods.
- 5.3Delivery times published by Australia Post are estimates of Australia Post, commence from dispatch, and do not form part of the Contract. We will provide the Customer with a tracking number on dispatch.
- 5.4Risk in the Goods passes to the Customer on delivery to the Delivery Address. Title in the Goods passes to the Customer on our receipt of payment in full.
- 5.5If Goods are returned to us because the Delivery Address was incorrect or incomplete, we will re-dispatch the Goods on payment by the Customer of the further postage.
- 5.6If Goods are lost in transit, the Customer must notify us. We will make enquiries with Australia Post and, once Australia Post confirms that the Goods are lost, will at our option supply replacement Goods or refund the price paid for them.
6.Cancellation
- 6.1Because Goods are made to order, the Customer may not cancel a Contract once it has been formed.
- 6.2We may cancel a Contract by notice to the Customer if we are unable to supply the Goods, in which case we will refund in full all amounts paid under that Contract.
- 6.3This clause 6 does not affect any right of the Customer under the ACL.
7.Consumer guarantees, returns and refunds
- 7.1Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
- 7.2We do not provide a refund or exchange where the Customer has changed their mind, or has ordered Goods of the wrong type, colour, size or specification.
- 7.3If Goods are damaged on arrival, faulty, not as ordered or not as described, the Customer is asked to notify us within 7 days of delivery, with photographs, by a message on the Order in their account or by email to 3d@ljbstudios.com.au. Prompt notice allows us to make any claim against the carrier. A failure to notify within that period does not limit any right of the Customer under the ACL.
- 7.4Where the Customer is entitled to a remedy, we will repair or replace the Goods or provide a refund in accordance with the ACL. Where we require the Goods to be returned, we will provide a prepaid return label, and the Customer will not bear the cost of returning faulty Goods.
- 7.5Refunds are made to the payment method used for the Order. The time taken for a refund to reach the Customer’s account depends on the Customer’s financial institution.
- 7.6Goods produced by additive manufacturing (3D printing) have visible layer lines and may vary slightly in colour between batches of material and in dimension within normal manufacturing tolerances. These characteristics are inherent in the method of manufacture and do not of themselves constitute a defect.
8.Custom Parts
- 8.1The Customer is responsible for the accuracy and completeness of the Customer Materials.
- 8.2If a Custom Part does not fit or function as specified because of an error in measurement or modelling made by us, we will remake the Custom Part at no charge.
- 8.3If a Custom Part does not fit or function as specified because of the Customer Materials, any remake will be the subject of a further Quote.
- 8.4We do not make safety-critical parts, parts for use under pressure, items intended to come into contact with food or drink, toys for young children, or reproductions of another person’s design for sale. The full list is published on our services page, and we may decline any Order that falls within it.
9.Use of Goods
- 9.1The Customer is solely responsible for the selection, installation, fitting, use, maintenance and disposal of the Goods, and for ensuring that the Goods and their use comply with all laws, regulations, standards, codes, permits and rules that apply in any place in which, or for any purpose for which, the Goods are used.
- 9.2Clause 9.1 applies to every use of the Goods, including without limitation use in, on or in connection with: motor vehicles, trailers and road use; electrical, gas, plumbing and building work; drones, vessels and aircraft; workplaces, including work health and safety obligations; products for children, products worn on the body, and medical, food-contact or potable-water applications; recreational, hunting, fishing and sporting activities; and export from or import into any jurisdiction. Such requirements differ between States and Territories and change from time to time.
- 9.3Without limiting clause 9.1, the Customer is responsible for ensuring that any Goods fitted to or used in a vehicle comply with the applicable road rules, vehicle standards and roadworthiness requirements, including requirements concerning the driver’s field of view, number plates, lights and mirrors, and items mounted on a windscreen or dashboard.
- 9.4Unless expressly stated on the product page or in a Quote, the Goods are not tested, certified or approved to any standard, rating or approval, and are not designed or supplied for any safety-critical application.
- 9.5The Customer must comply with any instructions, warnings or limitations supplied with the Goods, and must cease using Goods that are damaged or worn.
- 9.6To the extent permitted by law, we are not liable for any loss, damage, injury, fine or penalty arising from the installation or use of the Goods in breach of any law, regulation or standard, in an unsafe manner, or contrary to our instructions, and the Customer indemnifies us against any claim by a third party arising from such installation or use.
- 9.7We may decline any Order, or refuse to make any Goods, where we reasonably believe the Goods are intended for an unlawful or unsafe use.
- 9.8Nothing in this clause 9 limits any right of the Customer under the ACL in respect of Goods that are not of acceptable quality.
10.Intellectual property
- 10.1The Customer warrants that it owns, or is entitled to use, the Customer Materials, and that our use of them to make the Goods will not infringe the intellectual property or other rights of any person.
- 10.2The Customer grants us a non-exclusive licence to use the Customer Materials for the purpose of quoting for, making and supplying the Goods, and of making them again at the Customer’s request. We will not disclose the Customer Materials to any third party except as required to perform the Contract or by law.
- 10.3To the extent permitted by law, the Customer indemnifies us against any claim that our use of the Customer Materials in accordance with the Contract infringes the rights of any person.
- 10.4All intellectual property in the designs of Goods offered in the Shop remains with us. The purchase of Goods does not confer any right to copy, reproduce or commercially exploit any design.
11.Limitation of liability
- 11.1Subject to clause 1.5, where the law permits us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to the replacement or repair of the Goods, the supply of equivalent goods, or the payment of the cost of replacing or repairing the Goods or of acquiring equivalent goods.
- 11.2Subject to clause 1.5, we are not liable for any indirect or consequential loss, or for any loss of profit, revenue, data or opportunity, arising out of or in connection with a Contract.
- 11.3We are not liable for any delay or failure in performance caused by circumstances beyond our reasonable control.
12.Privacy
- 12.1We collect, use and disclose personal information in accordance with our Privacy policy.
13.Notices and contact
- 13.1Notices and enquiries in relation to an Order may be given by a message on the Order in the Customer’s account, or by email to 3d@ljbstudios.com.au.
- 13.2We may give notices to the Customer by email to the address provided with the Order.
14.General
- 14.1These Terms are governed by the laws of Western Australia, and each party submits to the non-exclusive jurisdiction of the courts of Western Australia.
- 14.2If any provision of these Terms is invalid or unenforceable, it is to be read down or severed to the extent necessary, and the remaining provisions continue in effect.
- 14.3A failure or delay by us in exercising any right is not a waiver of that right.
- 14.4We may amend these Terms from time to time. The Terms published on the Shop at the time an Order is placed apply to that Order.
